What is wrong with the proposed law on cross-border protection of adults? - Infographic

Along with European Network on Independent Living, Inclusion Europe, Mental Health Europe and AGE Platform Europe and also endorsed by the European Council of Autistic People we propose amendments on the Regulation on Protection of Adults in Cross-Border Situations urging the EU and its Member States to uphold their CRPD commitments and the 2021 Council Conclusions on protecting vulnerable adults.

We urge EU institutions to amend the Regulation to prevent human rights violations against persons with disabilities and older adults. Given the significant impact of this law, we have created an infographic to clearly present our position and its implications.

The European Commission introduced a proposal for a Regulation governing the cross-border protection of adults affecting directly: persons with disabilities and older adults. They are considered unable to protect their interests in cross- border situations, such as having money abroad, seeking medical care, or relocating within the EU.

Our concerns: We recognise the importance of legislation. However, several binding provisions are not in line with the UN CRPD.

  • The recognition of deprivation of legal capacity across the Union.
  • Unclear recognition of supported decision-making mechanisms.
  • Facilitated cross-border placement in residential and psychiatric institutions.

Our demands:
We propose to:

  1. Protect rights through supported decision-making. Amend articles 2, 3, 4, 13, 34, 37 and 45
  2. Restrict cross-border placements to those based on personal choice and support. Amend article 21
  3. Safeguard privacy by removing provisions on protection registers. Delete articles 45, 46, 47 and 48
