Background

The European Disability Forum is an independent NGO that defends the interests of 100 million Europeans with disabilities. EDF is a unique platform which brings together representative organisations of persons with disabilities from across Europe. EDF is run by persons with disabilities and their families. EDF is a front runner for disability rights. We are a strong, united voice of persons with disabilities in Europe.

EDF has a regular human rights report series concerning the rights of persons with disabilities in the EU. The series looks at both the EU and national level and generates recommendations for both levels. The first issue was in 2016 to mark 10 years of the Convention on the Rights of Persons with Disabilities. This was an introductory publication and provided a baseline to assess progress at the EU and Member States levels regarding CRPD ratification. Issues until now covered: the sustainable development goals and CRPD (2018), equality and non-discrimination (2019), poverty and social exclusion (2020), COVID-19 (2021), political participation (2022) and employment (to be published soon).

EDF will produce its 8th human rights report on the topic of the legal capacity of persons with disabilities.

The report will aim to explain the barriers persons with disabilities face to exercise their legal capacity in line with the UN Convention on the Rights of Persons with Disabilities (CRPD). The report will give a state of the art of legal capacity regimes in the different EU Member States. It will look at how deprivation of legal capacity leads to human rights abuses, including coercion and control of people’s life, and offer promising legal and policy developments to promote supported-decisions regimes and practices.

Objective and expected deliverables of the consultancy

The consultant will collect and analyse information on the topic of legal capacity of persons with disabilities. The following tasks and deliverables are foreseen:

  • Research and explanatory text on legal capacity of persons with disabilities, based on the CRPD, General Comment No. 1 of the CRPD Committee and other relevant documents
  • Analysis and summary of legal capacity regimes in EU Member States, i.e. mapping of EU Member States’ legal capacity regimes (guardianship, curatorship, supported decision making, power of representation)
  • Research and explanatory text on human rights violation linked to deprivation of legal capacity in Europe (e.g. forced treatment and placement in psychiatry; forced sterilisation, abortion and contraception)
  • Research and explanatory text on promising law, policies and practices on supported-decisions regimes and practices in EU Member States
